General terms and conditions

1. Scope and provider
These terms apply to all orders in the schildwerk.ch online shop. The provider and your contracting party is Aimara AG, Via Palü Daint 15, 7537 Müstair, Switzerland ("Schildwerk" or "we"). Customers are natural persons or legal entities ordering in the shop ("you").
Deviating terms of customers only apply if we have expressly agreed to them in writing.
2. Customer account
You need a customer account to order. Keep your password secret. You can have your account deleted at any time by emailing info@schildwerk.ch; we keep order data for as long as the law requires (see the privacy policy).
3. Conclusion of the contract
The products shown in the shop are not a binding offer but an invitation to order.
How to order: design the product and choose its options, add it to the cart, sign in, enter your shipping and billing address, choose a payment method and place a binding order with "Place order". Until that last click you can check and correct all details in each step.
The contract is concluded when we confirm your order by email. You can also find the order with all details in your customer account. The contract languages are German and English; in case of differences, the German version prevails.
We may still decline an order after confirming it if its content violates section 6 or the price was shown incorrectly because of an obvious technical error. In that case we refund any amount already paid in full.
4. Prices and payment
All prices are in Swiss francs (CHF) and include the statutory value added tax. Delivery within Switzerland is free of charge unless stated otherwise during checkout. The price shown when you place the order applies, including any quantity and combination discounts.
You can pay with the payment methods offered during checkout, in particular:
- TWINT
- Credit and debit card, also via Apple Pay or Google Pay (processed by Stripe)
- Invoice for companies, payable within 30 days of the invoice date; for this you enter the company in the billing address
We may exclude individual payment methods in individual cases. Card and TWINT are only possible from an amount of CHF 0.50. If a voucher covers the whole order, you pay nothing and do not need to choose a payment method.
For every order you receive an invoice by email as soon as we ship the order or it is ready for pick-up; the invoice is dated that day. You will also find the invoice in your customer account. If you pay with TWINT or card, the amount is charged when you place the order, and the invoice is marked as paid. The payment appears on your card or account statement as "AIMARA AG* SCHILDWERK".
Voucher codes: you can redeem one voucher code per order; if you enter a second one, it replaces the first. A code applies in addition to the quantity and combination discount and is calculated after them. Each code is subject to the conditions we announce with it, such as validity period, minimum order value, one redemption per customer or a link to your customer account or email address. A code with a fixed amount only applies to the order in which you redeem it; we do not credit any remaining amount. Voucher codes cannot be paid out in cash. If an order is cancelled, a code redeemed for it is usually used up; if we are responsible for the cancellation, we issue you a code of the same value.
5. Production and delivery
We deliver within Switzerland only, free of charge with Swiss Post. Instead, you can also pick up your order free of charge at one of our pick-up locations in Müstair, Scuol or Chur.
Production usually takes 5 working days, counted from the working day after the conclusion of the contract (Monday to Friday, excluding public holidays and company holidays), plus shipping time (usually one working day). Steel pictures are usually made within 10 working days; if you order them together with signs, the later date applies. We show you the expected delivery or pick-up date before you order and in the order confirmation. If you choose "Not urgent" for urgency, we produce your sign together with other orders, usually within 10 working days; in return the price is lower. Express production is available on request.
Delivery times are estimates. If delivery is significantly delayed, we will let you know; you may then withdraw from the contract if we do not meet a reasonable additional deadline.
If you want to change or cancel an order, contact us as soon as possible by email to info@schildwerk.ch or by phone. As long as we have not started production, we cancel it free of charge and refund any amount already paid in full. After that, a cancellation is only possible with our agreement.
For business customers, the risk passes on handover to the carrier; for consumers, on handover of the goods to them. For pick-up, the risk passes on handover at the pick-up location.
6. Your content and designs
You are responsible for ensuring that the texts, images, logos and fonts you use or upload for your design do not infringe any third-party rights (in particular copyright, trademark, name and personality rights) or applicable law. This also applies to fonts you upload to your brand kit: by uploading them you confirm that you may use them for printed products. We do not check third-party rights. If third parties assert claims against us because of your content, you indemnify us insofar as you are at fault.
You grant us the right to store and process your content to the extent necessary for production, for handling your order and for your brand kit.
We decline orders with content that violates applicable law or public morals, in particular racist, discriminatory, sexist, pornographic, violence-glorifying, offensive or extremist content.
Colours may differ slightly from the preview depending on the screen, material and printing process. Such minor differences are not a defect.
7. No right of withdrawal
Under Swiss law there is no statutory right of withdrawal or return for online orders. Our products are made individually for each order; returns are therefore excluded. Your rights in case of defects (section 8) remain unaffected.
8. Defects and warranty
Please check the delivery on receipt and report defects as soon as possible by email to info@schildwerk.ch, ideally with photos. Report obvious defects within 10 days of receipt and defects discovered later immediately after discovering them.
In case of a defect, we will, at our choice, replace the product free of charge or repair it. If this fails, you may demand a price reduction or withdraw from the contract. The warranty period is two years from delivery. Errors in your own details or content (e.g. typos in the text, images with too low a resolution despite a warning) are not a defect.
9. Liability
We are liable for damage we cause intentionally or through gross negligence. Liability for slight negligence, consequential damage and loss of profit is excluded to the extent permitted by law. Liability for personal injury and under the Product Liability Act remains unaffected.
10. Copyright of the website
The design, texts, images and templates on schildwerk.ch are protected by copyright. You may use them only for orders in our shop.
11. Data protection
The privacy policy explains how we process your personal data.
12. Changes to these terms
We may change these terms. Your order is governed by the version published when you placed it.
13. Applicable law and place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the registered office of Aimara AG. For consumers, the mandatory places of jurisdiction provided by law apply (for residents of Switzerland in particular Art. 32 of the Civil Procedure Code); mandatory protective provisions of the law of their place of residence remain reserved.
